WASHINGTON (AP) -- Federal authorities may prosecute sick people who smoke pot on doctors' orders, the Supreme Court ruled Monday, concluding that state medical marijuana laws don't protect users from a federal ban on the drug.

The decision is a stinging defeat for marijuana advocates who had successfully pushed 10 states to allow the drug's use to treat various illnesses.

Justice John Paul Stevens, writing the 6-3 decision, said that Congress could change the law to allow medical use of marijuana.

The closely watched case was an appeal by the Bush administration in a case that it lost in late 2003. At issue was whether the prosecution of medical marijuana users under the federal Controlled Substances Act was constitutional.

Under the Constitution, Congress may pass laws regulating a state's economic activity so long as it involves "interstate commerce" that crosses state borders. The California marijuana in question was homegrown, distributed to patients without charge and without crossing state lines.

Stevens said there are other legal options for patients, "but perhaps even more important than these legal avenues is the democratic process, in which the voices of voters allied with these respondents may one day be heard in the halls of Congress."

California's medical marijuana law, passed by voters in 1996, allows people to grow, smoke or obtain marijuana for medical needs with a doctor's recommendation. Alaska, Colorado, Hawaii, Maine, Montana, Nevada, Oregon, Vermont and Washington state have laws similar to California.

In those states, doctors generally can give written or oral recommendations on marijuana to patients with cancer, HIV and other serious illnesses.

In a dissent, Justice Sandra Day O'Connor said that states should be allowed to set their own rules.

"The states' core police powers have always included authority to define criminal law and to protect the health, safety, and welfare of their citizens," said O'Connor, who was joined by other states' rights advocates.

The legal question presented a dilemma for the court's conservatives, who have pushed to broaden states' rights in recent years, invalidating federal laws dealing with gun possession near schools and violence against women on the grounds the activity was too local to justify federal intrusion.

O'Connor said she would have opposed California's medical marijuana law if she was a voter or a legislator. But she said the court was overreaching to endorse "making it a federal crime to grow small amounts of marijuana in one's own home for one's own medicinal use."

The case concerned two seriously ill California women, Angel Raich and Diane Monson. The two had sued then-U.S. Attorney General John Ashcroft, asking for a court order letting them smoke, grow or obtain marijuana without fear of arrest, home raids or other intrusion by federal authorities.

Raich, an Oakland woman suffering from ailments including scoliosis, a brain tumor, chronic nausea, fatigue and pain, smokes marijuana every few hours. She said she was partly paralyzed until she started smoking pot. Monson, an accountant who lives near Oroville, California, has degenerative spine disease and grows her own marijuana plants in her backyard.

They should just legalize it and get it over with. And this is ridiculous. Which must be pretty obvious coming from someone who is straightedge.

"OMFG THIS LADY HAS CANCER AND SHE SMOKES POT TO RELIEVE THE PAIN CLUB HER TO DEATH."

I mean. Come on. seriously.

Yeah I saw the article and it pissed me off. There are people out there who the only drug that releaves their pain is pot. I cant believe the judges had the nerve to say people who are crittically/terminally ill and in severe pain that they can go [censored] themselves.

Alcohol; gets you drunk, not many deaths.
Cigarettes; gives you lung cancer; most places have "smoke breaks".

Pot: makes you happy, no differant than alcohol and doesn't give your [censored] lung cancer like cigs do.

by all means, POT is better for you than cigs, i fail to see the problem with one and not with the other...

well the alcohol point can be desputed by drunk driving, and the cigarettes as well as there is cancer from second hand smoke, and the pot is just a brain killing drug.

but taking it away from people who are suffering and dying/terminally ill? that's just cruel.

yeah. totally lock them up in prison so they can not only be in pain while they day, but they can be completely miserable too!

yeah. sounds great :p

Wanna bet? C'mon gizzy, use your head man. That's the kind of thinking we had in the 60's about cigarretes. You are putting freshly combusted material into your lungs... I don't care what you're burning, smoke is carcinogenic and WILL cause cancer. Plain and simple. The only thing is how fast it it'll happen.

'eh I mainly ment it's not AS BAD as Cig's, not nessessarily "won't cause cancer" motive; I know that smoke + lungs = bad no matter how you look at it; that is, if you smoke the pot wink ... What about eating it...

One of the nations biggest oposition forces against leagalising pot.... Dum dum dum..... The alcohol industry. Sounds crazy but it is true. After the 1920's the Liquor buissness was picking back up now leagal again to sell. But they noticed something. Poeple were actualy switching to weed for a buz while liquor was outlawed.

Now the funny thing about this is the 1920's liquor was banned until someone had the good sense to say, this is not stoping anyone. Now that was a whole decade. How far are we now on the war on drugs? Two?, Three?, decades now? To tell anyone you can not have what you can grow and produce is just ignorant.

Weed is bad for the lungs. Very bad. It also has long term mental effects. As we grow and become adulta our brain is wireing up for our future. Weed smoke can "un-wire" you permantely.
